David Marsh, lease renewal of Unit 4 Kestrel Yard

Details

  • Client or matter: David Marsh, lease renewal of Unit 4 Kestrel Yard
  • Date and time: Not stated
  • Attendees: Rachel Okafor (solicitor), David Marsh (client)
  • Type: Telephone call

Purpose

David Marsh called about the heads of terms the landlord's agent sent for a new lease of the bakery at Unit 4 Kestrel Yard.

What the client said

  • Confirmed that the current lease ends on the 30th of June.
  • Said the landlord's agent sent heads of terms yesterday for a new ten-year lease, with the rent going up from 24,000 to 28,500 a year.
  • Said the break clause at year five is for the landlord only, and that he wants a break for the tenant too, in case the business has to move.
  • Said the landlord wants a deposit of six months' rent.
  • Said he has been there eight years and has never paid late.
  • Asked whether to push back on the rent, and what the work will cost.
  • Agreed to the estimate of 2,500 plus VAT, and instructed the firm to go ahead with the renewal.

Advice given

  • Advised that a tenant break at year five is common on a ten-year lease, and to ask for a mutual break on six months' notice.
  • Explained that the landlord will want conditions on the break, such as the rent paid up to date, and that these should be kept as light as possible.
  • Advised that the rent is a commercial point and his decision, and to ask the agent how they got to 28,500. If similar units nearby are cheaper, he has something to negotiate with.
  • Advised asking whether a deposit of three months' rent will do, as landlords often agree when the tenant has a good record.
  • Said the firm will make sure the new lease is not contracted out of the 1954 Act, so he keeps his right to renew when it ends.
  • Estimated the cost of the renewal at 2,500 plus VAT, to be set out in the engagement letter.

Agreed next steps

  • Email the heads of terms to Rachel (David Marsh, this afternoon)
  • Review the heads of terms and send the points to raise with the agent, with the engagement letter (Rachel Okafor, by Friday)

How it works

  1. Paste or transcribe the call

Paste a transcript from Teams, Zoom or your phone, or turn a recording into text with the speech to text tool first. Add the client or matter and the length of the call.

  2. Get the attendance note

Claude, the AI from Anthropic, writes what the client said, the advice given and the next steps, and works out the time in 6-minute units.

  3. Copy it to the file

Paste the note into your case management system or the client file, and the time entry into your time recording.

What goes in an attendance note

An attendance note is the firm's record of a conversation with a client. In the UK the note of a call is a telephone attendance note. In Australia it is a file note, and in the US a memo to file. The name changes, the job does not: a colleague who was not on the call can pick up the matter from it, and it shows later what the client said and what they were told.

A good note records when the call took place and who was on it, the client and the matter, why the call happened, the client's instructions and the facts they gave, the advice given, and what was agreed: who does what, and by when. Note what the client asked, in their words where it matters, and what they agreed to, such as your estimate of the costs. A call with the other side or their lawyer gets a note too: then it records what they said and proposed.

Firms that bill by the hour usually record time in 6-minute units, a tenth of an hour each. A call of 1 to 6 minutes is 0.1, a call of 18 minutes is 0.3, and a call of 61 minutes is 1.1. The time entry is one line for the bill: what was done, about what, and what came of it, such as "Telephone call with Mr Smith re lease renewal; advised on the break clause; agreed to send the draft by Friday."

Write the note on the day of the call, while you still remember it. The generator writes only what is in the transcript. Where the call does not say something, such as the date, it writes "Not stated", so you know what to add before the note goes on the file.

Questions

What is an attendance note?

A written record of a call or meeting with a client, kept on the client file: who took part, what the client said, the advice given, what happens next and the time spent. In the UK the note of a call is a telephone attendance note. In Australia it is a file note, and in the US a memo to file.

Which transcripts work?

Any text of the call in any language: a transcript from Microsoft Teams, Zoom or Google Meet, or the one your phone made. Timestamps and speaker names can stay in. If you have a recording, transcribe it first with the speech to text tool: it runs in your browser, so the audio is never uploaded. Up to 40,000 characters, which is about 45 minutes of talk. The note comes back in the language of the call.

Is this legal advice?

No. The tool writes down what was said in the call. It does not check the advice or add any of its own. Read the note and correct it before it goes on the file.

Is my transcript stored?

Superscribe does not save it or write it to a log. To write the note it goes to Claude, the AI from Anthropic, which does not train its models on it.

How many notes can I write?

Up to 10 a day, and 5 in any 10 minutes. The limit is shared with the call notes generator and the other note tools, so they stay free for everyone.

Can I get this after every call?

The Superscribe app comes close. It records calls on the number you already have, on iPhone, Android or Mac, and writes the call note, the tasks and the CRM entry when you hang up. There is no transcript to paste.
