Can you record a phone call in Cyprus?
Everyone on the call must agree before you record it. Cyprus law makes recording a private call or conversation a crime unless every participant has given prior express approval.
- Phone calls
- The Protection of the Secrecy of Private Communication Law (92(I)/1996) makes it a crime to intercept or monitor any private communication, and monitoring includes listening to or recording it with any device. The exception needs the prior express approval of everyone who makes and everyone who receives the communication. For obscene, annoying or threatening anonymous calls, the approval of one party is enough.
- Business calls
- GDPR and Cyprus's data protection law (125(I)/2018) apply. On top of that, the 1996 law requires prior express approval from everyone on the call, so get it before recording. Tell callers why you record and how long you keep recordings, and delete them when that purpose ends.
- What counts as consent
- Ask before recording and get a clear yes from everyone on the call. The law asks for prior express approval, so a beep, or a notice that people simply talk through, carries risk.
- Penalties
- Up to 10 years in prison, a fine of up to EUR 100,000, or both. Disclosing or using the content of an unlawful recording is punished the same way.
Say this at the start
Telling everyone and asking is the safe habit everywhere.
- English
Before we start: I record my calls so I can keep accurate notes. Is that OK with you?
- Greek
Πριν ξεκινήσουμε: καταγράφω τις κλήσεις μου για να έχω ακριβείς σημειώσεις. Συμφωνείτε;
Worth knowing
- Law 13(I)/2020 raised the maximum penalty from 5 to 10 years in prison and added a fine of up to EUR 100,000. A 2015 amendment had already raised it from 3 to 5 years.
- The law protects any oral, written or electronic communication made where people reasonably expect privacy, so in-person conversations follow the same rule.
